Terms of Service

Welcome to Finger Math. These Terms of Service (“Terms”) govern Your access to and use of the Finger Math mobile application (the “Service”). Please read them carefully before creating an account or using the Service.

By creating an account, ticking the “I agree” checkbox at sign-up, or otherwise accessing or using the Service, You agree to be bound by these Terms. If You do not agree, do not use the Service.

1. Definitions

“Company”, “We”, “Us”, “Our” refers to Finger Math.
“Service” refers to the Finger Math mobile application and any related backend services We operate.
“You”, “Your” refers to the individual using the Service.
“Account” refers to the credentials and profile You create to access the Service.
“Content” refers to all material available through the Service, including hand-position illustrations, lesson text, quiz questions, audio, images, and software.

2. Eligibility

You must be at least 16 years old to create an account and use the Service. If You are between 16 and the age of legal majority in Your jurisdiction, You represent that Your parent or legal guardian has reviewed and agreed to these Terms on Your behalf.

By creating an account, You confirm that:

You are at least 16 years old.
The information You provide is accurate and current.
You have the legal capacity to accept these Terms.

We reserve the right to refuse service, close an account, or cancel access at Our sole discretion if We have reason to believe these representations are untrue.

3. Your Account

3.1 Registration

When You create an account, You provide an email address, choose a username, and set a password. You are responsible for keeping Your credentials confidential and for all activity that occurs under Your account.

The Service enforces single-device sign-in via a session token. Signing in on a new device may automatically sign You out on previous devices.

3.3 Account Security

You agree to notify Us immediately at support@omeecron.tech of any unauthorized use of Your account. We are not liable for losses caused by unauthorized use that occurred before We received Your notification.

3.4 Account Deletion

You may delete Your account at any time from within the Application (Profile → Delete Account). Deletion is immediate and permanent. Details of what is deleted or anonymized are described in Our Privacy Policy.

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable local, state, national, or international law.
Reverse-engineer, decompile, disassemble, or attempt to extract the source code of the Service, except to the extent such restriction is prohibited by law.
Scrape, automate, or otherwise use the Service in a manner that exceeds normal human usage (for example, scripted or bot traffic to Our backend endpoints).
Bypass, disable, or otherwise interfere with security features of the Service (including Firebase App Check, rate limits, or session-token enforcement).
Create multiple accounts to evade restrictions or rate limits.
Submit feedback, content, or messages that are abusive, threatening, harassing, hateful, defamatory, sexually explicit, or otherwise inappropriate.
Attempt to gain unauthorized access to any account, system, or network connected to the Service.
Use the Service to distribute malware, viruses, or any other malicious code.

We may suspend or terminate Your access to the Service if You violate any of these rules.

5. Ownership and Intellectual Property

5.1 Our Content

The Service, including all Content, software, design, layout, trademarks, and branding, is owned by or licensed to the Company and is protected by copyright, trademark, and other intellectual property laws. You may use the Service only for Your personal, non-commercial educational purposes.

You may not copy, reproduce, distribute, publicly display, create derivative works from, or otherwise exploit any portion of the Content without Our prior written permission.

5.2 The ALOHA Chisanbop Technique

The finger-math technique itself (Chisanbop / ALOHA) is a pedagogical method in the public domain. Our specific illustrations, lesson progression, counting-sequence step-by-step visualizations, and quiz content are Our original work and are protected as described above.

5.3 Your License to Use the Service

Subject to these Terms, We grant You a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Service on devices You own or control, solely for Your personal, non-commercial use.

6. Feedback and User Submissions

When You submit feedback, bug reports, suggestions, ratings, or other content through the Service:

You grant Us a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and incorporate that feedback into the Service without obligation or compensation.
You represent that the feedback is Your own and does not infringe any third party’s rights.
You understand that feedback is not treated as confidential.

If You delete Your account, feedback You previously submitted is anonymized as described in the Privacy Policy; it is not automatically deleted.

7. Third-Party Services

The Service relies on third-party infrastructure, including Google Firebase (Authentication, Firestore, Cloud Functions, App Check) and Google Play Integrity. Use of the Service is also subject to those providers’ own terms. We are not responsible for third-party services or any interruptions, changes, or errors they may cause.

8. Service Availability and Changes

We strive to keep the Service available but We do not guarantee uninterrupted access. We may, at any time and without notice:

Modify, suspend, or discontinue any part of the Service.
Change features, pricing (if any is introduced in the future), or functionality.
Impose limits on usage or storage.

We are not liable for any loss or inconvenience resulting from such changes.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

The Service will meet Your specific requirements.
The Service will be uninterrupted, timely, secure, or error-free.
Any errors or defects will be corrected.
The results obtained from using the Service will be accurate or reliable.

The Service is an educational tool. Quiz scores and progress are informational; they are not certifications or academic credentials.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your access to or use of, or inability to access or use, the Service;
Any conduct or content of any third party on the Service;
Any unauthorized access, use, or alteration of Your transmissions or content.

Where applicable law does not allow the exclusion or limitation of liability for certain damages, Our total liability to You for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount You have paid Us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred Indian Rupees (₹100).

11. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its affiliates, officers, agents, and employees from any claim, liability, loss, or expense (including reasonable attorneys’ fees) arising out of:

Your use of the Service in violation of these Terms;
Your violation of any third party’s rights;
Any content You submit through the Service.

12. Termination

12.1 Termination by You

You may stop using the Service at any time by deleting Your account (Profile → Delete Account) or by uninstalling the Application.

12.2 Termination by Us

We may suspend or terminate Your access to the Service, with or without notice, if:

You violate these Terms.
We are required to do so by law.
We discontinue the Service.

12.3 Effect of Termination

Upon termination, Your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including Sections 5, 6, 9, 10, 11, and 13) will survive.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Gujarat, India.

If You are a consumer based in the European Union, You may also have the right to bring claims in the courts of Your country of residence under mandatory consumer protection laws.

14. Changes to These Terms

We may update these Terms from time to time. We will notify You of material changes by updating the “Last updated” date at the top of these Terms and, where appropriate, by posting a prominent notice in the Application prior to the change becoming effective.

Your continued use of the Service after changes take effect constitutes Your acceptance of the revised Terms. If You do not agree to the changes, You must stop using the Service and may delete Your account.
